JUSTICE BIRENDRA KUMAR ORAL ORDER 20-03-2018 Heard learned counsel for the petitioner, informant and learned Additional Public Prosecutor for the State. The petitioner is languishing in custody for the offences punishable under Sections 420/406 of the Indian Penal Code. Later on offences under Sections 120B/467/471/472/468 of the Indian Penal Code was added.

The FIR would reveal that the dispute arose out of a business transaction between the parties. Civil remedy is already available with the informant.

Learned counsel for the informant opposed the prayer for bail.

Submission is that the petitioner is in custody since

Patna High Court Cr.Misc. No.15520 of 2018 (2) dt.20-03-2018 P2/ 19.12.2017. The direct involvement in business is against the brother of the petitioner with the informant. Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Dehri P.S. Case No.335 of 2017, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
