The petitioner seeks bail in Paharkatta P.S. Case No.35 of 2019, registered under Section 392 of the Indian Penal Code.

The informant lodged the case against unknown for robbery of his motorcycle.

Learned counsel for the petitioner submits that nothing has been recovered from the possession of the petitioner but the Investigating Officer shown the recovery of the robbed motorcycle from the house of the petitioner.

It appears that during the course of investigation, petitioner was arrested and on the basis of his confession looted motorcycle was recovered from the house of the petitioner.

Patna High Court CR. MISC. No.10770 of 2020(2) dt.29-02-2020 2/2 Taking into consideration the facts aforesaid, I am not inclined to enlarge the petitioner on bail. Accordingly, the prayer for bail of the petitioner is rejected.
