The petitioner apprehends his arrest in Sheohar P.S. Case No.293 of 2018 registered under Sections 30(a), 37(A) and 37(C) of Bihar Prohibition and Excise Act.

The S.H.O. of Sheohar alleged that he got information that petitioner and others were selling toddy in the orchard of Sheohar Estate. When the raid was conducted, 40 liters of toddy is said to have been recovered from the hut situated in the orchard of the petitioner.

The learned counsel for the petitioner submits that the hut does not belong to the petitioner. Petitioner has falsely been implicated in the case. Nobody has seen the petitioner selling the toddy in the orchard.

No.11155 of 2019(2) dt.25-02-2019 2/2 Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional District & Sessions Judge-cum-Special Judge, Excise Act, Sheohar in connection with Sheohar P.S. Case No.293 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
