JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 08-07-2020 Heard learned counsel for the petitioners and learned counsel for the State via video conferencing. By way of the present application, the petitioners have sought for pre-arrest bail in connection with Pothia P.S. Case No.139 of 2019 registered for the offences punishable under Sections 341, 323, 354B, 379, 504, 506 read with 34 and 307 of the Indian Penal Code.

Considering that the instant case has been instituted after two days of the occurrence and prior to the institution of the present case petitioner no.1 Noor Mohammad @ Noor Mahmad had already filed Pothia P.S. Case No.138 of 2019 against the husband of the informant and others as also that five

Sagir, Raja, Makbul Rahman, Sahida @ Raseda Khatoon and Gajala having identical allegations have already been granted pre-arrest bail vide order passed in Cr. Misc. No.10164 of 2020, the petitioners are directed to be released on bail in the event of their arrest or surrender in the court below on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kishanganj in connection with Pothia P.S.
