This is an appeal under Section 14(A)(2) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 against the refusal of prayer for bail by the learned Special Judge (S.C./S.T. Act)-cum-1st Addl. Sessions Judge, Purnea, in connection with Special (SC/ST Act) No.332 of 2017 (arising out of Baisi Police Station Case No.219 of 2017) registered under Sections 147, 148, 149, 452, 341, 325, 307, 302, 427, 504 of the Indian Penal Code and Section 3(i)(V)(x) and 3(2)(V) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.

The allegation is general and omnibus against the appellant and others to have committed assault to the father of the informant for land dispute, as a result whereof, father of the informant died during course of the treatment. The Doctor has found single injury caused by hard and blunt substance at the chest, it was cause of death. Other injuries were on non-vital

Considering the general and omnibus nature of allegation, let the appellant, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with the aforesaid case, with condition that the appellant shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the appellant. Accordingly, the appeal stands allowed.
