The petitioner is in custody in connection with Saraiya P.S. Case No. 452 of 2018 for the offences under Sections 147, 148, 149, 341, 323, 324, 325, 354, 337, 338, 307, 302 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he is in custody since 26.11.2018 He further submits that the name of the petitioner has surfaced during the course of investigation and he was not named in the F.I.R. He further submits that co-accused Laxaman Ram was granted bail by the Co-ordinate Bench of this Court in Cr. Misc. No. 2959 of 2019 vide order dated 23.01.2019.

No.12091 of 2019(2) dt.27-02-2019 2/2 Considering the fact that petitioner has no criminal antecedent and similarly circumstance co-accused has been granted bail by Co-ordinate Bench of this Court, the Court is inclined to grant bail to the petitioner, let the petitioner be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Court of learned 1st Additional Chief Judicial Magistrate (West) Muzaffarpur in connection with Saraiya P.S. Case No. 452 of 2018.
