JUSTICE BIRENDRA KUMAR ORAL ORDER 24-04-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

Petitioner is languishing in custody for the offences punishable under Sections 364(A)/34 of the Indian Penal Code. The FIR reveals that the son of the informant telephonically informed that he has been kidnapped by the miscreants for ransom. On the very same day, the son of the informant was rescued but he never appeared before the police for statement under Section 161 or 164 Cr.P.C., rather during the investigation it reveals that he was himself instrumental in managing the stage for getting more money from his father. Considering the aforesaid facts, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-

Patna High Court Cr.Misc. No.11404 of 2017 (3) dt.24-04-2017 (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-cum-Sub-Judge-10th, Muzaffarpur/Successor Court, in connection with Brahmpur P.S. Case No.229 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court below shall be at liberty to take steps for cancellation of the bail bonds of the petitioner in this case.
