JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 28-02-2019 Heard learned counsel for the petitioners, no one appears on behalf of the State to oppose this application. Petitioners are seeking anticipatory bail in connection with Khaira P.S. Case No.326 of 2018 registered for the offences punishable under Sections 413, 414, and 411/34 of the Indian Penal Code.

Learned counsel for the petitioners submits that the Bolero vehicle in question was bearing Registration Number BR04F-6107 which has been verified from the D.T.O. Office, Saran at Chapra and it has been found that petitioner no.2 is the owner of the seized vehicle. Petitioner no.1 is said to be the son of petitioner no.2. Learned counsel submits that it is a case of false implication on mere suspicion as the petitioner no.2 had purchased the vehicle from the registered owner and had got the vehicle

Patna High Court CR. MISC. No.11349 of 2019(2) dt.28-02-2019 2/2 transferred in his name.

It is further submitted that the petitioners have no criminal antecedent.

In the given facts and circumstances of the case, considering that prima-facie the report of the D.T.O is said to have stated that the Registration Number of the vehicle stands in the name of petitioner no.2, let in case of arrest or surrender of the petitioners within a period of four weeks from today, the abovenamed petitioners are directed to be enlarged on bail on furnishing bail bond of Rs.15,000/- (rupees fifteen thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M-X, Saran at Chapra in connection with Khaira P.S. Case No.326 of 2018, subject to the condition that petitioners shall join the investigation by reporting to the Investigating Officer within a period of two weeks from today and shall cooperate in course of investigation. This will be in addition to condition prescribed under Section 438(2) of the Cr.P.C. (Rajeev Ranjan Prasad, J) R.R.Ojha/- U T
