JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 24-03-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Basopatti P.S. Case No. 181 of 2013 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 427, 379, 504 of the Indian Penal Code.

Although, petitioners are named in the first information report but no specific overt-act has been attributed against them. Para-3 to the petition reveals that petitioners do not have any criminal antecedent.

Learned counsel for the petitioners submits that nothing has been recovered from conscious possession of the petitioners and as a matter of fact, they have been implicated in

Patna High Court Cr.Misc. No.11625 of 2015 (2) dt.24-03-2015 this case on account of previous enmity.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioners, in the event of their arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Madhubani in Basopatti P.S. Case No. 181 of 2013 subject to condition as laid down under Section 438(2) of the Cr.P.C.
