JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-02-2019 This is an application for grant of anticipatory bail in connection with Parsa Bazar P.S. Case No. 275 of 2018, disclosing offences under Sections 341, 323, 447, 376/511, 379 of the Indian Penal Code.

Allegation against the petitioner is of entering inside the house of the informant and trying to rape upon her and when she raised hulla, then the petitioner taken away Rs.4700/- and fled away.

Submission of learned counsel for the petitioner is that as a matter of fact the father of the informant has taken Rs.5,000/- from the petitioner and when he demanded his money, the present case has been lodged against him. Further, there is delay in lodging the F.I.R.

Heard learned A.P.P. also, who opposed the prayer for

Patna High Court CR. MISC. No.12263 of 2019(2) dt.27-02-2019 2/2 anticipatory bail of the petitioner.

Having heard both sides, considering the facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioner, rather he should surrender and make prayer for regular bail, which will be considered on its own merit, without being prejudice by order of this Court. Accordingly, this application is dismissed.
