JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 29-04-2016 By way of the present application preferred under Articles 226 and 227 of the Constitution of India, the petitioner seeks quashing of the FIR of Bagaha P.S.Case No. 127 of 1994 registered under Sections 409, 420, 467, 468, 471 and 120-B of the Indian Penal Code.
At the outset, it has been submitted by the learned counsel for the State that the investigation of the aforesaid police case has already been completed and a report under Section 173(2) of the Code of Criminal Procedure has been submitted by the police in the court of jurisdictional Magistrate, vide Charge-sheet No. 212 of 2014 dated 13th August, 2014.
Keeping in mind the subsequent developments
Patna High Court Cr. WJC No.363 of 2015 (3) dt.29-04-2016 2/2 whereby investigation has already been completed, learned counsel for the petitioner concedes that this application has become infructuous.
In that view of the matter, the application is disposed of as infructuous.
