Petitioner, already in custody, seeks bail in connection with Madhepura (Bharrahi O.P.) P.S. Case No.848 of 2017, registered under Sections 341, 323, 324, 307, 504, 34 of the Indian Penal Code.

Allegation in brief is that on the exhortation given by the petitioner, the other co-accused assaulted the informant side. Learned counsel for the petitioner submits that there is land dispute between both sides, there is no specific overt act of committing any assault by the petitioner and the petitioner has no criminal antecedent.

Having considered the aforesaid facts and circumstances, petitioner Sunil Kumar is directed to be released on bail on

Patna High Court Cr.Misc. No.16317 of 2018(2) dt.26-03-2018 2/2 furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Madhepura in connection with Madhepura (Bharrahi O.P.) P.S. Case No.848 of 2017.
