Petitioner seeks bail in Supaul P.S. Case No.472 of 2016 for the offence punishable under Section 392 of the Indian Penal Code.

It has been submitted that the petitioner is in custody since, 27.10.2016. He is not named in the written report and his name has come during investigation on the basis of the confessional statement of the co-accused. No Test Identification Parade (TIP) has been held in this case. It has been submitted that the person from whose possession the alleged motorcycle has been recovered was granted bail by a co-ordinate bench of this Court vide order dated 24.03.2017 in Criminal Miscellaneous No. 7853

Patna High Court Cr.Misc. No.21647 of 2017 (2) dt.11-05-2017 2/2 of 2017.

Considering the above facts and circumstances, this petition for bail is allowed and the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Supaul P.S. Case No.472 of 2016 to the satisfaction of learned Chief Judicial Magistrate, Supaul subject to the condition that both the bailors should be close relatives of the petitioner.
