JUSTICE MOHIT KUMAR SHAH ORAL ORDER 14-09-2022 The present petition has been filed seeking the following relief :- "(i) For issuance of an appropriate writ in the nature of mandamus, commanding and directing the respondent-1st set to remove the encroachment over the Gairmajarua land of Bihar Sarkar bearing Khata no. 896, Khesra no. 1077 measuring an area 0.03 decimals

Patna High Court CWJC No.7389 of 2021(2) dt.14-09-2022 2/2 situated in Mauza-Dadhabari Bispatti, AnchalSursand, District-Sitamarhi by which the government drainage is passing away and due to illegal encroachment of the same by the respondent- 2nd set, there is water logging in the area which badly affected the crops."

At the outset, the learned counsel for the petitioners seeks liberty on behalf of the petitioners to approach the Circle Officer, Sursand, Sitamarhi i.e. the respondent no. 5 for redressal of his aforesaid grievance. Liberty so sought, is granted. It is needless to state that in case, the petitioners approach the respondent no. 5 by filing appropriate petition under the provisions of the Bihar Public Land Encroachment Act, 1956, within a period of four weeks from today, the same shall be considered, in accordance with law and after hearing the affected parties, appropriate orders shall be passed thereon, forthwith. The writ petition stands disposed off on the aforesaid terms.
