The present application has been filed for quashing of the First Information Report of Raghopur P.S. Case No.72/2015 registered under Sections 147, 148, 149, 341, 323, 307, 504 and 506 of the Indian Penal Code and 27 of the Arms Act, pending in the Court of learned CJM, Vaishali.

It is submitted by learned counsel for the petitioner that maliciously the present FIR was lodged for the same incident by changing the time of occurrence. Though, earlier for the same occurrence Raghopur P.S. Case No.72/2015 was registered. In view of this Court, at this stage the petitioner has not made out a case for interference.

Accordingly the application is disposed of with

Patna High Court Cr.Misc. No.10849 of 2016 (2) dt.01-07-2016 2/2 liberty to the petitioner to raise all the contentions after submission of final report under section 173(2) Cr.P.C.
