2. This application has been filed on behalf of the petitioner for quashing the order dated 05.12.2019 passed by Additional Chief Judicial Magistrate-I, Supaul in connection with Pipra P.S. Case No. 16 of 2010.

3. Learned counsel for the opposite party has filed counter affidavit and learned counsel for the petitioner has filed supplementary affidavit and the same are taken on record.

4. The allegation against the petitioner is that he along with other three accused persons has defalcated with the records and assets of the Primary Health Centre, Pipra.

5. Upon perusal of the impugned order, it appears that a strong prima facie case has been found against the petitioner for framing of charge and this Court finds no infirmity in the impugned order.

6. Accordingly, this application is dismissed.

7. The Court below is directed to expedite the trial of the petitioner.
