JUSTICE SANJAY KUMAR ORAL ORDER 22-05-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 147, 148, 149, 341, 323, 324, 307, 379, 427, 354 and 506 of the Indian Penal Code.

Allegation against petitioner is to have assaulted informant with Dabia resulting head injury and the dispute arose due to damaging banana tree of informant.

It has been submitted on behalf of petitioner that he has falsely been implicated in the present case. There is case and counter case between the parties. The dispute arose on account of previous land dispute. Injuries caused are simple in nature. There is no specific allegation against petitioner. Petitioner is languishing in jail custody since 19.03.2017. It is further submitted that similarly situated other co-accused persons have already been granted anticipatory bail by the court below. On behalf of the State it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the

No.22670 of 2017 (2) dt.22-05-2017 2/2 above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IInd, Jhanjharpur, Madhubani, in connection with Phulparas P.S. Case no. 322 of 2015 ( G.R. no. 1943 of 2015).
