JUSTICE DINESH KUMAR SINGH ORAL ORDER 10-03-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 109 of the Indian Penal Code and Section Sections 3(2) read with Section 13 (1)(e) of the Prevention of Corruption Act.

It is alleged that the husband of the petitioner being an employee of FCI, Government of India has acquired disproportionate assets in form of movable and immovable property in his name and in the name of the petitioner. On conclusion of the investigation, the CBI came to the conclusion that the husband of the petitioner has acquired assets of `1,06, 04,743/- against the received salary of `48,87,612/- between the check period of 27.11.2003 to 22.08.2013. During investigation, it was found that the petitioner abetted her husband in acquiring the

Patna High Court Cr.Misc. No.5117 of 2015 (3) dt.10-03-2015 2/2 disproportionate assets by taking fake claim that she was running dairy firm and having income from agriculture. This is not in dispute that the investigation has already concluded, chargesheet has been submitted and consequently cognizance has been taken. This is also not the claim of the CBI that the petitioner has not cooperated during investigation. Considering the fact that the investigation has concluded, the husband of the petitioner has been granted bail and petitioner is a lady, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, CBI-III, Patna in connection with Special Case No. 01 of 2014 arising out of RC Case No. 27A of 2013, subject to the conditions as laid down under Section 438(2) Cr.P.C.
