Learned counsel appearing on behalf of the petitioner submits that the petitioner was denied payment of salary for the period he was put under suspension and even before the order of suspension petitioner was denied salary. He further submits that now the petitioner is getting regular salary and the writ application is confined to payment of arrears of salary and the salary for the period petitioner was put under suspension.

The writ application is disposed of with a direction to respondent no.3, the District Education Programme Officer (Establishment), Bhagalpur, who shall examine the claim of the petitioner and if the claim of the petitioner is found genuine, the respondent no.2 is under legal and moral obligation to ensure payment of admitted dues including the arrears of salary within a maximum period of three months from the date of receipt/production of a copy of this order after verifying the relevant record available with the respondents. With the aforesaid, the writ application stands disposed of.
