JUSTICE ARUN KUMAR ORAL ORDER 09-03-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Banka (Barahat) PS Case No. 618 of 2017 registered under Sections 409 and 420 of the IPC.

The allegation in brief is that eight lack forty-eight thousand rupees was taken by the petitioner in advance for construction of school building but the construction is not complete and only he has returned four lakh fifty-five thousand rupees and rest amount was not returned.

Learned Counsel for the petitioner submits that he made part construction and incurred part of the amount which is said to have not been returned back, whereas he has returned four lakh fifty-five thousand rupees.

Having considered the said facts and circumstances, the petitioner, namely, Md. Zulkar Nain @ Gulkar Nain is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Banka in connection with Banka (Barhat) PS Case No. 618 of 2017.
