JUSTICE SUDHIR SINGH ORAL ORDER 16-07-2015 The petitioner is apprehending his arrest in connection with Chandradeep P.S. Case No. 79 of 2013 for the offence under Sections 409, 467, 468, 471, 420/34 of the Indian Penal Code.
Heard learned counsel for the petitioner and the State.
The prosecution story, in brief, is that the petitioner being the In-charge Head Master of school withdrew Rs. 6,31,000/- from S.B.I. Aliganj vide school S/B. Account for construction of building and defalcated the money. It is submitted on behalf of the petitioner that the certain amount was allotted to the school for its development. The petitioner being the in-charge of that school had made certain expenses in respect to the development of the school. Subsequently, he was transferred from there. On his transfer
Patna High Court Cr.Misc. No.25873 of 2015 (2) dt.16-07-2015 he deposited the balance amount in the account of the school which is evident from Annexure-5. Hence, there is no misappropriation of the Government funds.
On behalf of the State, it has been submitted that the petitioner is named in the First Information Report. Considering the aforesaid facts, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Jamui in connection with Chandradeep P.S. Case No. 79 of 2013, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Sudhir Singh, J) P.K./- U T
