03-07-2020 Heard learned counsel for the petitioner as well as learned A.P.P. for the State through video conferencing. The petitioner apprehends his arrest in Bahadurpur P.S. Case No. 620 of 2019 registered for the offence under Sections 30(a) and 37(C) of the Bihar Prohibition and Excise Act, 2016.

As per prosecution case, 8 liters of country-made (Mahua) liquor and 1 liter & 125 ml. of foreign liquor have been recovered from the hut of the petitioner.

It is submitted on behalf of petitioner that petitioner has falsely been implicated and nothing has been recovered from the possession of the petitioner. It is further submitted that the hut, from where recovery has been effected, does not belong to petitioner and petitioner has clean antecedent.
