The petitioner is apprehending arrest in a complaint case wherein process has been directed to be issued after cognizance being taken for the offences punishable under Sections 420, 406 and 343 of the Indian Penal Code. It is alleged that Rs.75,000/- was given to the petitioner for providing employment in foreign country but neither employment was provided to the informant nor money was returned.

It is submitted by learned counsel for the petitioner that there is no proof with regard to the payment to the petitioner. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Complaint Case No.2893 of 2009, pending before the Chief Judicial Magistrate, Siwan.

With the above observation, this application is, accordingly, disposed off.
