JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 25-02-2019 Heard learned counsel for the petitioner and the State. The petitioner is in custody in connection with Bagaha P.S. Case No. 575/2018, for the offence under Section 272/273 of the Indian Penal Code and section 30(a) of the Bihar Prohibition & Excise Act.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent. In the instant case total 40 litres of liquour was seized from a plastic bag kept on the bicycle belonging to this petitioner.

The petitioner is in custody since 30.11.2018. Considering the fact that the petitioner has no criminal antecedent, the petitioner named above, is directed to be released on bail on furnishing bail bonds of Rs. 10,000 (Ten thousand) with two sureties of the like amount each to the
