The petitioner has preferred this application for grant of regular bail in a case registered under sections 420 and 406 of the Indian Penal Code, sections 4 and 5 of the Prevention of Black Marketing Maintenance of Supplies of Essential Commodities Act and Section 7 of the Essential Commodities Act.
As per the prosecution case, the petitioner, who is a PDS dealer, was caught black marketing grains as detailed in the F.I.R..
It is submitted by learned counsel for the petitioner that the petitioner, who is a PDS dealer, has been falsely implicated in the case. No such occurrence as alleged in the F.I.R. has taken place. On the other hand, the license of the
Patna High Court CR. MISC. No.13011 of 2022(3) dt.22-12-2022 2/2 petitioner has been suspended and a certificate case has been initiated against him. The petitioner is in custody since 30.12.2021 and chargesheet has been submitted in the case. Heard learned A.P.P. for the State.
Having heard learned counsel for the parties and taking into consideration the nature of allegation together with the petitioner having remained in custody for more than 11 months since 30.12.2021, the Court directs the petitioner to be enlarged on bail in connection with Desari (Sahdei O.P.) P.S. Case no.276 of 2021 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Vaishali at Hajipur.
