====================================================== CORAM: HONOURABLE MR. JUSTICE A. M. BADAR ORAL ORDER 17-11-2021 This is an application for regular bail to the applicant/accused in Crime No.345 of 2020 registered with Police Station- Laukaha for the offences punishable under Sections 392 and 411 of the Indian Penal Code at the instance of the first informant Md. Irshad.
This application is taken out of turn for hearing in view of the fact that the applicant has produced Admit-Card to show that he is appearing for examination of Diploma in Elementary Education, 2021.
Heard learned counsel appearing for the applicant/ accused.
He submits that charge-sheet is already filed and the investigation in crime in question is already over. It is further
Patna High Court CR. MISC. No.22581 of 2021(3) dt.17-11-2021 2/3 argued that the applicant is student having no criminal antecedent. The motorcycle which is alleged to be robbed by the accused persons is recovered at the house of some other accused.
Learned Additional Public Prosecutor opposed the application by contending that the case diary is not mentioning any criminal antecedent of the applicant/accused. I have considered the submissions so advanced and also perused the materials placed before me.
The investigation of the crime in question is already over. The recovery has already been effected. No criminal antecedents of the applicant are shown and, therefore, the following order:
(i) The application is allowed.
(ii) The applicant/accused in Crime No.345 of 2020 registered with Police Station- Laukaha for the offences punishable under Sections 392 and 411 of the Indian Penal Code be released on bail on executing P.R. bond of Rs.15000/- (Rupees Fifteen Thousand) on furnishing surety in the like amount to the satisfaction of the trial court with the following conditions:
(I). The applicant should not extend any threat,
