JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-05-2015 Heard learned counsel for the petitioners and the State.

Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 420,

Patna High Court Cr.Misc. No.15924 of 2015 (2) dt.05-05-2015 467, 468, 471/34 of the Indian Penal Code.

It is alleged that the retiral benefit of the husband of the informant was transmitted to the C.S.P. Branch, at Jalalpur and when the informant went to withdraw the amount of Rs. 1,77,962/-. then Branch Manager, Deepak Kumar Singh suggested to invest the money in fixed deposit scheme for one year. On his suggestion Rs. 1,98,000/- was deposited in the F.D. scheme, but subsequently informant came to the know that the amount was transferred in the account of Prity Kumari and Pooja Kumari, who are the sisters of Branch Manager, Deepak Kumar Singh. Name of the petitioner Pankaj Ray @ Pankaj Rai @ Pankaj Kumar Pilot sprang up during investigation as the persons who supplied some paper for investment of informant's money in some private financial company.

It is submitted by the learned counsel for the petitioners that the amount has already been returned to the informant and the informant has entered into a compromise. Considering the thrust of accusation against Deepak Kumar Singh, let the learned court below consider the prayer for regular bail of the petitioner namely Deepak Kumar Singh, if he surrenders before the learned court below within a period of six weeks from today in connection with Bheldi P.S. Case No. 191 of 2013, pending in the court of learned Judicial Magistrate, Ist Class, Saran at Chapra.

No.15924 of 2015 (2) dt.05-05-2015 Considering the fact that petitioners Priti Kumari and Pooja Kumari are unmarried girls, these two petitioners and Pankaj Ray @ Pankaj Rai @ Pankaj Kumar Pilot are not responsible for transfer of the amount, let them be released on bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Saran at Chapra in connection with Bheldi P.S. Case No. 191 of 2013, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
