2. The petitioner, who is in custody since 20.09.2016, has renewed his prayer for bail in connection with Sakra P.S. Case No. 260 of 2016 for the offences alleged under Sections 302 and 120B/24 of the Indian Penal Code having earlier been rejected by this Court by order dated 20.07.2017 in Criminal Miscellaneous No. 15354 of 2017.

3. It is submitted that the petitioner has already been in custody for about two and half years. In a subsequent development, other co-accused Sanjay Singh @ Sanjay Kumar Singh and Ranjeet Kumar Singh @ Munna Singh have since been granted bail by this Court in Cr. Misc. No. 71012 of 2018 and Cr. Misc. No. 53215 of 2018, respectively.

4. Learned APP assisted by learned counsel for the informant appearing suo motu opposes the bail petition, inter alia, pointing out that in the case of co-accused Mahesh Roy @ Mahesh Kumar Roy, who had been denied bail, this Court by order dated 04.04.2019 in Cr. Misc. No. 7342 of 2018 has granted

Patna High Court CR. MISC. No.12354 of 2019(3) dt.01-05-2019 2/2 four months' further time for conclusion of trial.

5. Pursuant to the order dated 06.03.2019 status report dated 18.03.2019 has been received, according to which seven prosecution witnessess including the I.O. have already been examined. The matter was fixed for 23.03.2019 for prosecution evidence for examination of the witness of inquest report.

6. Having regard to the nature of accusations and gravity of offence alleged as well as the stage of trial, this Court is not inclined to grant the privilege of bail to the petitioner. The bail petition stands dismissed.
