2. The petitioners apprehend their arrest in a case registered for the offence punishable under Section 137(2) of the B.N.S..
3. As per prosecution case, informant, namely Mohammad Khan, alleged that his daughter, namely Sadiya Hatima, went to Maharana Pratap College, Mohania to attend classes but did not return. During search, her friend informed that she was last seen with co-accused Faisal Khan. Informant suspects that his minor daughter has been kidnapped by coaccused Faisal Khan for the purpose of marriage.
4. It is submitted by learned counsel appearing on
Patna High Court CR. MISC. No.11445 of 2025(2) dt.21-03-2025 2/3 behalf of the petitioners that petitioners are quite innocent and have committed no offence. As a matter of fact, Petitioner No. 1 is mother and Petitioner No. 2 is father of co-accused Faisal Khan, who is alleged to have kidnapped minor daughter of informant for the purpose of marriage. There is no specific accusation of kidnapping against these petitioners and they have falsely been implicated in this case only because they happen to be parent of co-accused Faisal Khan. Petitioners claim clean antecedents.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioners.
6. Considering the aforesaid facts and circumstances, nature of accusation and clean antecedents of the petitioners, the prayer for grant of anticipatory bail to the petitioners is allowed.
7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named petitioners be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Mohania, District- Kaimur in connection with Durgawati P.S. Case No. 387 of 2024, subject to condition as laid down under Section
