JUSTICE DINESH KUMAR SINGH ORAL ORDER 01-04-2016 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Section 147, 148, 149, 323, 341, 307, 504/34 of the Indian Penal Code. The prosecution case is that on protest being made by the husband of informant for ploughing his land the accused persons assaulted the husband of informant and when son of the informant came to rescue he was also assaulted. It is submitted by the learned counsel for the petitioners that in the background of land dispute the accusation of assault has been levelled and the injury has been found to be simple and there is counter version of the occurrence also.
Patna High Court Cr.Misc. No.14210 of 2016 (2) dt.01-04-2016 2/2 Statement has been in paragraph 3 of the petition that the petitioner has no criminal antecedent. Though, it is submitted that petitioners were not sent up for trial but differing with the police report learned Magistrate took cognizance against the petitioners but no statement to that effect has been made in the petition. Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Supaul in connection with Kishanpur P.S. Case No. 61 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
