The petitioner is languishing in judicial custody since 27.06.2018 in connection with Chandan P.S. Case No. 13 of 2017 for the offence alleged under Section 395 of the Indian Penal Code.

The prosecution case, as lodged by the Assistant Branch Manager, State Bank of India, Chandan, Banka, is that a dacoity was committed in the branch by 5-6 criminals, who made the close circuit television camera defunct and looted away Rs.39,7480/- of cash.

It has been submitted by the learned counsel for the petitioner that he is innocent, not named in the first information report, no test identification parade has been done so far

Patna High Court CR. MISC. No.15029 of 2019(2) dt.14-03-2019 2/3 although the date of occurrence is 17.02.2017 and the petitioner is languishing in judicial custody since nine months. Charge sheet has already been submitted, there being no allegation of tampering with the prosecution witnesses. He submits that two of the co-accused, whose names surfaced during investigation, have already been granted the privilege of bail by coordinate Benches of this Court in Cr. Misc. No. 254 of 2018, dated 12.01.2018 and Cr. Misc. No. 64022 of 2018, dated 09.01.2019. He submits that petitioner has been made accused only on suspicion and no recovery has been made from the petitioner. However, the learned Additional Public Prosecutor for the State opposes the prayer for bail stating therein that petitioner is involved in one more case of similar nature in the State of Jharkhand.

Considering the facts and circumstances, the nature of allegation, the materials on record and that on similar allegations two of the co-accused have since been granted privilege of bail, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Chandan P.S. Case No. 13 of 2017 to the satisfaction of the learned Chief Judicial
