The petitioner is accused in connection with Forbesganj (Simraha) P.S. Case No. 421 of 2016 registered under sections 304(B)/34 of the I.P.C. pending in the Court of C.J.M., Araria.
Submission is that petitioner is innocent and has falsely been implicated in this case due to village politics. It is also submitted that petitioner is in custody since 16.08.2016 and he has no criminal antecedent.
Learned A.P.P. appearing on behalf of the State opposed the prayer of the petitioner with submission that petitioner is husband of the deceased and there is direct allegation
Patna High Court Cr.Misc. No.21232 of 2017 (2) dt.12-05-2017 2/2 against him for committing the murder deceased and the witnesses have also supported the prosecution case in several paragraphs of the case diary.
Having considered the facts and circumstances of the case and nature of allegation, I am not inclined to allow the prayer of the petitioner for bail. Accordingly, this application is rejected. (Arvind Srivastava, J) Shailendra/- U T
