====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 17-06-2019 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Basnahi P.S. Case no. 110 of 2017, registered under Sections 302 and 201/34 of the Indian Penal Code. The accusation is that Subhash Rishidev, husband of the informant, namely, Soni Devi used to do the work as labour at the house of petitioner and her husband Subhash Rishidev made demand of wage from petitioner and his sons Chandan Tudu, Video Tudu and Jitendra Tudu, but they did give any heed on it. When Subhash Rishidev did not return to his house for more than eight days, then informant made query then she was informed that her husband moved from the house

Patna High Court CR. MISC. No.12060 of 2019(5) dt.17-06-2019 2/2 of petitioner after taking his wages. Later on, on 14.12.2017 Subhash Rishidev was found dead at the bank of Sursar river. Thereafter, informant raised suspicion that petitioner in connivance with Chandan Tudu, Video Tudu, Jitendra Tudu and others murdered her husband.

Learned counsel for the petitioner submits that except suspicion nothing has been collected by the I.O in the case diary which is up to paragraph No. 90. Further submission is that petitioner has no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate-III, Saharsa in connection with Basnahi P.S. Case No. 110 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
