JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 28-09-2022 Heard learned counsel for the petitioner and learned APP for the State and perused the case diary. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 302 and 201/34 of the Indian Penal Code.
As per allegation in the FIR, in order to conceal a dead body, some one has thrown the same near the southern side of road situated near Kesiya river. The dead body was unclaimed and then present FIR against unknown. It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that on the basis of confessional statement of coaccused Abinash Kumar and Jai Shankar Singh @ Shankar Singh, the name of the petitioner came into light. He further

Learned APP appearing for the State opposed the anticipatory bail.
Considering the aforesaid submissions, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Smt. Puja Sharma, Judicial Magistrate, Ist Class, Bhagalpur in connection with Nathnagar (Madhusudanpur) P.S. Case No. 273 of 2021 corresponding to G.R. No.1902 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
