2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 103(1) and 3(5) of BNS.

3. The case of the prosecution is that on 19.11.2025, the petitioner along with others has assaulted the husband of the informant due to which he received head injury and became unconscious. It is further alleged that the petitioner and others rushed him to hospital where he died during treatment.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Learned counsel for the petitioner has submitted that from perusal of the

It has also been submitted that the petitioner and the deceased are own brother. He has further submitted that from perusal of the postmortem report, it will transpire that the doctor conducting the autopsy of the deceased has found no mark of external injury on the person of the deceased and the cause of death has been described as cardio respiratory failure due to underlying chronic diseases. Learned counsel has submitted that actually, the deceased was suffering from various diseases and has died due to that reason. A statement has been made in para-3 of this petition that the petitioner has got no criminal antecedent. Moreover, he is languishing in judicial custody since 28.11.2025.

5. Learned APP appearing for the State and learned counsel for the informant have vehemently opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Garkha P.S. Case No. 894 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount
