2. The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Kartaha P.S. Case no. 58 of 2024 instituted for the offence under Sections 147, 341, 342, 283, 188, 353, 323, 504 and 506 of the Indian Penal Code.

3. The prosecution case is that the raid was made on secret information that liquor was being sold at Chataro Chowk. It is further alleged that three persons were apprehended and after breath analyzing, it was found that they were consumed liquor. It is further alleged that after sometime, police received information that 40-50 persons have gathered and blocked the road and petitioner was identified one of them from the video footage. Accordingly, the FIR.

4. Learned counsel for the petitioner has submitted that petitioner is innocent and has falsely been implicated in

Patna High Court CR. MISC. No.11826 of 2025(2) dt.21-02-2025 2/2 connection with the present case. It is further submitted that no overt act has been alleged against the petitioner. Petitioner is having clean antecedent. Further submission is that similarly situated co-accused has since since been extended the privilege of bail vide order dated 18.10.2024 passed in Cr. Misc. No. 68825 by this Court.

5. Learned APP appearing for the State opposed the prayer of bail of the petitioner.

6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Kartaha P.S. Case no. 58 of 2024, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-Vth Vaishali at Hajipur, subject to the conditions as laid down under section 438(2) of the Cr.P.C.
