Mr. Dr. Kumar Uday Pratap ====================================================== CORAM: HONOURABLE MR. JUSTICE S. KUMAR ORAL ORDER 05-04-2018 Heard learned counsel for the petitioner and the State. This is an application for regular bail in connection with Harshidi P. S. Case No. 399 of 2017 registered for the offences punishable under Sections 413 and 414 of the Indian Penal Code.

On receiving information informant, who is a police officer, proceeded towards Raghopur Rogiya Inad and found two thieves standing who used to loot motorcycle. On seeing police they started to flee away but one out of two was apprehended and he disclosed the name of petitioner. It is submitted by learned counsel for the petitioner that he is innocent and has falsely been implicated in the present case. The motorcycle which was recovered from the house of petitioner is of petitioner's brother. Except confessional

Patna High Court Cr.Misc. No.14073 of 2018(3) dt.05-04-2018 2/2 statement of co-accused, there is nothing against petitioner. He is in custody since 26.11.2017. It is further submitted that one similarly placed co-accused has been granted bail by a Bench of this Court in Cr. Misc. No. 13958 of 2018.

Considering the facts and circumstances of the case, let above named petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran, in connection with Harsidhi P. S. Case No. 399 of 2017.
