The petitioners seek bail in connection with Rajauli P.S. Case No. 260 of 2021 instituted for the offences under Sections 30(a) (d) and 41 of the Bihar Excise Act. Learned counsel for the petitioners submits that the petitioners are in custody since 28.09.2021, charge-sheet has been submitted in the case and have antecedent of five cases. Allegation is of recovery of 80 litres of liquor along with 5000 litres of fermented mahua from a forest. Learned counsel for the petitioners submits that the petitioners were not arrested from the spot and they came to be

Patna High Court CR. MISC. No.12961 of 2022(2) dt.22-03-2022 2/2 implicated based on disclosure made by the local choukidar with whom the petitioners are on an inimical term. Learned A.P.P. for the State opposes the prayer for bail of the petitioners.

Considering the fact that the petitioners are in custody, charge-sheet has been submitted in the case and were not arrested from the spot, let the petitioners above named be released on bail on furnishing bail bond of Rs. 5,000/- (Rupees Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-cum-Special Judge-II, Excise, Nawada in connection with Rajauli P.S. Case No. 260 of 2021.
