The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 406, 420, 323, 468, 467, 504/34 of the Indian Penal Code. The learned counsel for the petitioners submits that petitioners had agreed to return an amount of Rs. 40,000/- to the informant within 4 weeks which was recorded in the order dated 27.04.2023 but despite best efforts of the petitioners the informant for reasons best known shows not to accept the amount as such petitioner has prepared a bank draft of Rs. 40,000/- to be paid to the informant.
Patna High Court CR. MISC. No.11972 of 2023(3) dt.21-06-2023 2/2 Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on provisional anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Jamalpur P.S. Case No. 109 of 2022 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. However, the learned trial court before confirming the provisional bail bonds of the petitioner shall ensure that payment of Rs. 40,000/- as agreed by the petitioners have been made to the informant within a period of 6 weeks after surrendering.
