Petitioner seeks bail in connection with Sahebpur Kamal P.S. Case No. 173 of 2016 registered for the offence under Sections- 47 of the Excise Act and New 53(B) and 54 Excise Act.
Learned counsel for the petitioner submits that nothing has been recovered from the conscious possession of the petitioner. Recovery is from Gautam Kumar who has already been granted bail by this Court vide order dated 28.03.2017 passed in Cr. Misc. No. 9304 of 2017. Petitioner has no criminal antecedent and is in custody since 22.09.2016. Considering the facts and circumstances of the

No.21554 of 2017 (2) dt.16-05-2017 2/2 case, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate V, Begusarai in connection with Sahebpur Kamal P.S. Case No. 173 of 2016.
