2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 302, 120(B) of the Indian Penal Code.
3. As per prosecution case, the petitioner along with other co-accused persons are alleged to have killed the daughter of the informant and hanged by putting rope around her neck.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The petitioner is husband of the deceased due to which he has falsely been implicated in this case. There is no prior complaint against the petitioner regarding torture or misbehave the deceased. No.12058 of 2023(4) dt.08-08-2023 2/2 further submitted that the deceased was under depression for not conceiving any child since her marriage that was solemnized eight years ago despite medical treatments and as such, she committed suicide herself. As per Postmortem report, doctor opined the cause of death is due to Asphyxia as a result of hanging. The petitioner has got no criminal antecedent. Moreover, he is languishing in judicial custody since 16.6.2022.
5. Learned APP appearing for the state has opposed the prayer of regular bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Bikramganj P.S. Case No. 225 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 19th Additional Sessions Judge, Rohtas at Sasaram.
