The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 504, 379, 506 of the Indian Penal Code. It is alleged that for cutting of soil from a rural road when protest was made by the informant the co-accused Ram Badan Roy assaulted with 'spade' on the head of the informant, thereafter petitioner nos. 6 and 10 assaulted the informant with 'lathi', the accused persons snatched Rs.3,000/- cash from the pocket of the informant.

No.13485 of 2015 (2) dt.06-05-2015 2/2 It is submitted by learned counsel for the petitioners that the injury of the informant has been found to be bruise of marginal size simple in nature whereas the grievous injury was caused by co-accused Ram Badan Ray non-petitioner. The petitioners' side also received injury. A statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.

Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saharsa in connection with Nawhatta P.S. Case No.75 of 2013, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Ashwini/- U T
