JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 01-06-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner apprehends arrest in connection with Kharik P.S. Case No. 232 of 2014 registered under section 366/34 of the Indian Penal Code.
It is alleged by the informant Anisha Khatoon wife of Late Seikh Muslim that her daughter Rounak Khatoon was married about three months before the occurrence and she was abducted by the accused Md. Aftab (petitioner) on the pretext of taking her to her Sasural. It is also alleged that her daughter has been induced by Md. Aftab with the help of Md. Sajjad and his maternal uncle Md. Shahjahan.
Learned counsel appearing on behalf of the
Patna High Court Cr.Misc. No.12963 of 2015 (2) dt.01-06-2015 petitioner submits that there was love affair between the petitioner and victim Bibi Rounak and she left her house out of her own free will. The victim girl in her statement under section 164 Cr.P.C. has stated that the maternal uncle of Md. Aftab took her and Md. Aftab to Bhagalpur Railway station and got them boarded in the train. When she reached at Delhi, there she met with the son of her sister. When he enquired from Md. Aftab that where he is going with the victim, then Md. Aftab fled away from there after leaving her.
Having considered the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender within four weeks, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Sub-divisional Judicial Magistrate, Naugachia, District Bhagalpur in connection with Kharik P.S. Case No. 232 of 2014, subject to the conditions laid down under Section 438(2) Cr.P.C.
