The petitioner seeks bail in Excise Case No. C"50 of 2017 registered under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

According to the prosecution report, Excise Superintendent raided the godown and apprehended Sunil Kumar Sharma, Alok Kumar Pathak (petitioner) and Rajan Kumar, the driver of the auto rickshaw. It appears that 198.18 litres of different brands of Indian made foreign liquor was recovered. It is submitted that Sunil Kumar Sharma confessed his guilt and disclosed that he had transported the liquor from Delhi. Sunil Kumar Sharma has already been enlarged on bail vide

Patna High Court Cr.Misc. No.21325 of 2017 (2) dt.10-05-2017 2/2 Cr. Misc. No. 21327 of 2017. The case of the petitioner stands on better footing.

Considering the facts aforesaid and the fact that the petitioner is in jail since 22.03.2017, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, West, Muzaffarpur in connection with Excise Case No. C"50 of 2017.
