JUSTICE SANJAY PRIYA ORAL ORDER 10-05-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Kankarbagh P.S. Case No. 104 of 2017 instituted for the offence under Sections-461, 379 of the Indian Penal Code.

It has been submitted that the petitioner is not named in the written report. He was arrested merely on suspicion and police recorded his confessional statement. It is alleged that one mobile set of Jio Company has been recovered from possessions of the petitioner. It is submitted that the said mobile has been purchased by the petitioner from Kankarbagh. The petitioner is an employee of Patna Municipal Corporation. The written report has been filed against unknown alleging that mobile phone was found and Rs. 1500/- was stolen from the box. In such circumstances, the prayer for bail is allowed and the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Kankarbagh P.S. Case No. 104 of 2017 to the satisfaction of Smt. Madhavi Singh, learned Judicial Magistrate-Ist Class, Patna subject to condition that both the bailors should be close relatives of the petitioner.
