The petitioner seeks bail in a case instituted under Sections 147, 148, 149, 323, 324, 307, 302, 447 and 504 of the Indian Penal Code.
The petitioner is said to have assaulted one Chote Yadav by means of lathi on his left forehead, causing injury to him.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 16.01.2017. The charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is said to
Patna High Court Cr.Misc. No.23497 of 2017 (2) dt.24-05-2017 2/2 have assaulted one Chote Yadav. There is no allegation of assault alleged against the petitioner upon the deceased. The deceased was assaulted by co-accused namely Ajay Yadav, Chandra Dev Yadav, Bhushan Yadav and Amar Yadav.
On behalf of the state, it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Bettiah, West Champaran, in connection with Yogapatti P.S. Case No. 326 of 2016.
