JUSTICE ANIL KUMAR SINHA ORAL ORDER 12-06-2019 Heard Mr. Prabhat Kumar Dipak, learned counsel for the petitioner and Mr. Raghunandan Kumar Singh, learned counsel appearing on behalf of the O.P.No. 2. The petitioner apprehends his arrest in connection with Complaint Case No. 133 of 2018 registered under Sections 323, 342, 498A, 504 and 506 of the Indian Penal Code and Sections 3 and 4 of the Dowry Prohibition Act. It appears that the matter was referred to Mediator, who has submitted his report dated 12.04.2019. From perusal of report, it appears that both parties i.e., husband and wife, have compromised the dispute and have agreed to withdraw the cases pending between them.
Patna High Court CR. MISC. No.12903 of 2019(3) dt.12-06-2019 2/2 After having taken into consideration the above fact, I am inclined to grant privilege of anticipatory bail to the petitioner. Accordingly, petitioner, namely, Aftab Alam, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt of a copy of this order, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned SDJM, Dehri in connection with Complaint Case No. 133 of 2018; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
