JUSTICE VINOD KUMAR SINHA ORAL ORDER 30-04-2019 This application, for grant of anticipatory bail, arises out of Goh P.S. Case No. 209/18, disclosing offences under 406 and 420 of the Indian Penal Code.

Allegation against the petitioners, who are the Chairman and Manager of Chapuk PACS is of misappropriation of Govt. money to the tune of Rs. 16,19,865.66/- Submission of learned counsel for the petitioners is that they have already deposited the amount in question in the Central Co-operative Bank Ltd. Goh, Aurangabad and in this connection, they have also filed a supplementary affidavit giving detailed description.

Having heard both sides, in view of the above facts, this application is disposed of with direction to the petitioner to surrender before the court below on 16.05.2019 and the court below shall call for a report from Central Cooperative Bank, Goh, Aurangabad and if it is found that the petitioners have already deposited the entire amount, the court below shall confirm the provisional bail of the petitioners otherwise, he is free to pass any order as he deems fit and proper.
