The petitioner seeks bail in connection with Special Case No.521 of 2018, arising out of Agamkuan P.R. (P.S.) Case No.519 of 2018, registered under Section 30(a) of the Bihar Prohibition and Excise Act.

The accusation is of recovery of 35 liters country made liquor from the lane, situated at the back of the house of the petitioner.

Learned counsel for the petitioner submits that it would appear from the prosecution report that the alleged recovery was not made from the house of the petitioner rather the petitioner has falsely been implicated in this case by the police on mere

Patna High Court Cr.Misc. No.18201 of 2018(2) dt.29-03-2018 2/2 suspicion because the lane, from where the alleged recovery was made, is situated at the back of the house of the petitioner. The petitioner having no criminal antecedent is in custody since 21.01.2018.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise, Patna, in connection with Special Case No.521 of 2018, arising out of Agam Kuan P.R. (P.S.) Case No.519 of 2018.
