====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 02-05-2019 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner is languishing in custody since 29.12.2018 in a case for the offence registered under Section 414 of the IPC.

The prosecution story, in brief, is that on 28.12.2018 at 9.30 A.M., the informant apprehended petitioner and coaccused Md. Daud riding on a Motorcycle. They did not produce any paper of the said Motorcycle. They disclosed that they have stolen the Motorcycle from Gopalganj. It has been submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in the present case. Charge sheet has been submitted in the present

Patna High Court CR. MISC. No.12832 of 2019(3) dt.02-05-2019 2/2 case. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The petitioner had no knowledge regarding the stolen Motorcyle in question. He had purchased the said Motorcycle in question without having knowledge that the same is stolen property. Other co-accused Md. Daud has been granted bail vide B.P. No. 31/2019 order dated 24.01.2019 by the learned court below itself vide Annexure-2 to the present bail application.

On behalf of the learned counsel for the State, it has been submitted that the petitioner is named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.- XIV, Gopalganj, in connection with Barauli P.S. Case No. 341 of 2018.
